Cue Terms of Service

These Terms of Service ("Terms") govern your access to and use of Cue, operated by INNOV8 Interactive LLC ("Cue", "we", "our", or "us"), including our website, web application, mobile applications, APIs, AI features, and related services (collectively, the "Service").
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be legally capable of entering into a binding agreement and meet the minimum age required by applicable law. If you are under the age of majority, you may use Cue only with permission from a parent or legal guardian.
2. Your Account
You are responsible for:
- •Maintaining the security of your account credentials.
- •All activity occurring under your account.
- •Providing accurate account information.
- •Promptly notifying us of unauthorized access.
We may suspend or terminate accounts that violate these Terms.
3. License to Use Cue
Subject to these Terms, Cue grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use.
4. Acceptable Use
You agree not to:
- •Violate any law or regulation.
- •Reverse engineer or attempt to access source code except where permitted by law.
- •Interfere with the operation or security of the Service.
- •Circumvent subscription or security mechanisms.
- •Upload malicious software.
- •Scrape or harvest data without authorization.
- •Impersonate another person.
- •Infringe intellectual property rights.
- •Use automated systems in a manner that degrades the Service.
5. User Content
You retain ownership of content you submit, including ratings, reviews, lists, notes, watch history, and profile information.
You grant Cue a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, and display your content solely as necessary to operate and improve the Service.
You represent that you have the rights necessary to submit your content.
6. AI Features
AI-generated recommendations and responses are provided for informational and entertainment purposes. They may be inaccurate, incomplete, or unavailable. You remain responsible for decisions based on AI-generated content.
7. Subscriptions and Payments
Certain features may require a paid subscription.
Subscriptions may renew automatically until cancelled through the applicable billing platform (such as Stripe, Apple App Store, or Google Play).
Prices may change prospectively with reasonable notice where required.
Taxes may apply.
Refunds are governed by the policies of the applicable payment provider and applicable law.
8. Intellectual Property
Cue, its software, design, branding, graphics, interfaces, and original content are owned by INNOV8 Interactive LLC or its licensors and are protected by intellectual property laws.
Movie and television metadata, artwork, and related information are supplied by third parties such as The Movie Database (TMDb) and remain the property of their respective owners.
Cue is not endorsed by or affiliated with TMDb unless expressly stated.
9. Third-Party Services
The Service may integrate with third-party providers including authentication, payment, AI, analytics, email, hosting, and metadata services. Your use of those services may also be governed by their respective terms and privacy policies.
10. Privacy
Your use of Cue is also governed by the Cue Privacy Policy, which is incorporated into these Terms by reference.
11. Availability
We strive to provide reliable service but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any feature at any time.
12. Beta Features
Features identified as alpha, beta, preview, or experimental may change or be discontinued without notice and may be less reliable than production features.
13. Suspension and Termination
We may suspend or terminate your access immediately if:
- •You violate these Terms;
- •Your use presents a security or legal risk;
- •We are required to do so by law.
You may stop using Cue and delete your account at any time.
14. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INNOV8 INTERACTIVE LLC, ITS OFFICERS, EMPLOYEES, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION ARISING FROM OR RELATED TO THE SERVICE.
WHERE LIABILITY CANNOT BE EXCLUDED, OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO CUE DURING THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) US $100.
Some jurisdictions do not permit certain limitations, so portions of this section may not apply.
16. Indemnification
You agree to indemnify and hold harmless INNOV8 Interactive LLC from claims, liabilities, damages, losses, and expenses arising from your misuse of the Service, your content, or your violation of these Terms.
17. Export Compliance
You agree to comply with applicable export control and sanctions laws.
18. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles, unless applicable law requires otherwise.
19. Changes to the Terms
We may revise these Terms from time to time. Material changes will become effective upon posting or as otherwise required by law. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
20. Severability
If any provision of these Terms is held unenforceable, the remaining provisions shall remain in full force and effect.
21. Entire Agreement
These Terms, together with the Privacy Policy and any additional policies expressly incorporated by reference, constitute the entire agreement between you and Cue regarding the Service.
